These terms and conditions (the "Terms and Conditions", “Terms”) govern the use of www.ornatealchemy.co.uk (“our site"). Our site is owned, operated and managed by Elaine Gemmell trading as Ornate Alchemy. Throughout the site, the terms “we”, “us” and “our” refer to the owner Elaine Gemmell trading as Ornate Alchemy.

These Terms and Conditions are the contract between you (anyone who use our site) and Ornate Alchemy (“us”). Please read these Terms carefully before accessing or using Our Site. By using the Ornate Alchemy website and/or purchasing from us you are agreeing to the terms and conditions outlined. These terms apply to all users of the site indicative of whether you purchase from us or are only browsing our content.

DEFINITIONS

In this contract:

“Our site” refers to www.ornatealchemy.co.uk

“We”, “us” or “our” refers to Elaine Gemmell trading as Ornate Alchemy (Ornate Alchemy)

“Content” refers to any content or material published on www.ornatealchemy.co.uk

“Goods” refers to any items we have for sale on our site or items that are purchased by you.

INTELLECTUAL PROPERTY

All published content (including but not limited to: photographs, graphics, names, jewellery designs, artwork, text, layout design) made available on our site is the property of Elaine Gemmell. This content may not be copied, reproduced, modified, used to create derivative works, displayed, published, transferred or sold. You may not exploit any of the content in whole or in part that is belonging to our website. If you wish to reference any parts of our website on your own you may first issue a request to seek our approval.

THIRD PARTIES

We are not responsible for the content of websites we link to. Our blog is designed to be an informative space and will often include external links to photographs, text and articles provided by third party websites. By including these links, we are not endorsing the linked websites and have no connection to the people who run them. You choose to click on these links at your own discretion and risk. We cannot be held responsible for the content or availability of pages we link to on other websites as links may no longer be available or updated.

TERMS OF SALE OF GOODS

These Terms and Conditions govern the sale of goods available on our site. Ornate Alchemy supplies the following goods for sale on our site: jewellery and accessories; art works.

We have a duty to supply goods that match the description of the good(s) you order on our site and to this end we endeavour to provide information, descriptors and images for our goods that are as accurate as possible. We have made every effort to be as accurate as possible regarding the colours and visuals of our goods however we cannot guarantee that your monitor’s (computer, laptop, tablet, phone screen etc) display of colour will be accurate to ours.

We have endeavoured to provide as much information regarding the goods as possible but cannot guarantee the accuracy of all goods we provide. We do not guarantee that the quality of goods purchased by you will meet your expectations. You agree to purchase goods from our site at your own risk.

The price of goods may be changed on the site by us at any time without notice.

PAYMENTS

Currently we accept the following payment methods on our site:

  • Credit Card

  • Debit Card

When you provide us with your payment information, you authorise our use of and access to the payment method you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment method.

Card payments are not processed through pages controlled by us. We use Stripe as an online payment service provider who will encrypt your card or bank account details in a secure environment.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

The price payable for the goods that you order is clearly set out on our site. We are not responsible for any additional costs that may apply: buyers are responsible for any customs and import taxes that may apply.

If, by mistake, we have under-priced goods, we will not be liable to supply those goods to you at the stated price (provided that we notify you before dispatch). In this event we will notify you through the contact details you provided (e-mail, telephone). If you do not wish to accept the item at the correct price a full refund will be issued via the method you paid by.

Our merchant’s name will be displayed on your statement as ORNATE ALCHEMY.

SHIPPING AND DELIVERY

The usual time for an order to be processed and despatched is 2-4 working days. Items are dispatched Monday-Thursday. This only applies to all our standard, ready-to-ship items in the shop. If, for whatever reason, there is a possibility that this processing and dispatch time could take longer than stated, the customer will be contacted by us as soon as possible.

The above time for processing and dispatch does not apply to items that are bespoke, custom, altered, personalised and ‘made to order’. These items have varying processing and dispatch times due to the work involved and external factors outwith our control, such as hallmarking. An estimate will be provided and agreed by the customer before an order is placed.

Goods purchased from our site will be sent by Royal Mail.

  • Orders under £30 will be sent by Royal Mail (usually Tracked 24). This service aims to deliver in two business days.

  • Orders £30 and over will be sent Royal Mail Special Delivery. Delivery usually takes 1-2 business days and a tracking number will be made available to you.

Once dispatched, delivery times are outwith our control and may vary due to unforeseen circumstance. Therefore our delivery times are estimates and cannot be guaranteed. Please note that delivery times do not include weekends and bank holidays.

It is the responsibility of you, the customer, to provide us with a complete and accurate delivery address and name of recipient. You are required to ensure all details entered at checkout are correct. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Buyers are responsible for any customs and import taxes that may apply. We are not responsible for any additional costs that may occur at customs. We are also not responsible for delivery delays due to customs.

RIGHT TO CANCEL 

If you are a customer living in the United Kingdom or the European Union you have the right to cancel your contract to purchase goods from us within 14 days without giving notice. The cancellation period will end 14 days from when you (or someone you nominate) receive your goods.

To exercise your right to cancel you must inform us of your decision to cancel within the 14 day cancellation period. To cancel, contact us by email at elaine@ornatealchemy.co.uk or by post at 29 Kirk Road, Bathgate, EH48 1BW. Alternatively there is a cancellation form available at the end of the page if you would prefer to use that.

The right to cancel does not apply to:

  • Bespoke or custom orders

  • Items that have been altered or personalised

EFFECTS OF CANCELLATION

You may cancel your order at any time within 14 days of the date you ordered the goods. You must notify us (see above) that you wish to cancel. 

We are unable to cancel orders that have already been dispatched. Once you have received your goods, you have 14 days from receipt to return them. Goods will be returned as per the terms laid out in our returns policy - detailed below and in our dedicated returns page. If you cancel your contract with us and the goods have already been dispatched, then you must return the goods to us as soon as possible after receiving them.

As per our returns policy, you will be responsible for the cost of returning the goods. When returning goods we strongly advise you to obtain proof of posting. We suggest using a tracked service that provides insurance and we would highly recommend Royal Mail Special Delivery for insurance purposes when the item being returned is jewellery. We cannot be responsible for any returned items until they reach us, and we are not responsible for any damage or loss to the goods that occurs before this point, including while the goods are in transit to us.

If you cancel your contract with us, we will refund all payments we received from you under the contract of sale, including the cost of delivery. We will process the refund to your original payment method without undue delay within 14 days from the date we receive the goods.

LIABILITY FOR SUBSEQUENT DEFECTS

Please examine the goods received from us immediately upon arrival. If you do not notify us of any defect or problem within 30 days of receipt of the goods, we shall assume that you have accepted them.

The procedure to return any faulty goods is as follows:

Please inform us of the discovery of any fault or defect by email: elaine@ornatealchemy.co.uk. When you contact us you should detail as clearly as possible what the fault is that you complain of, when it first became apparent and any other information that is relevant. You should also provide photographic evidence at this point to enable us to the appraise the fault or defect in the first instance.

If any defect is found, then we shall do one of the following:

  • endeavour to repair or replace the goods (or if this not possible)

  • refund the full cost you have paid, including the cost of returning the goods.

Due to the nature of our one-of-a-kind pieces, we cannot guarantee a like-for-like substitute in these cases.

We will refund your money via the original method of payment subject to the following conditions:

  • we receive the goods and packaging intact, returned to us

  • you comply with our return procedure and policy

Please be aware we cannot proceed with resolving the issue until the goods have been returned to us.

We are not liable for any subsequent damage to the goods as a result of fair wear and tear, misuse, accidental damage or improper handling, storage or care, contrary to that advised in the care instructions provided with the goods and available on our site.

If you report any of the items as being broken or damaged upon receipt (i.e. damaged in transit) you must provide photographic evidence that will allow us to take the situation further.

RETURNS

In the unlikely event that you are unhappy with your online purchase, you can return the goods to us for a refund within 14 days of receipt of order, providing the goods are returned in perfect condition and have not been worn. 

You must notify us via email within 14 days of receiving your goods of your decision to return the goods. You then have an additional 14 days to have the goods returned to us, in accordance with our returns policy.

Please be aware that we do not refund postage or courier fees incurred for unwanted items.

Refunds do not apply to the following goods:

  • Bespoke, custom or made-to-order

  • Items that have been specially altered

  • Earrings (unless otherwise faulty)

Please note, we do not offer exchanges on unwanted items. 

RETURNS PROCEDURE

You should email elaine@ornatealchemy.co.uk to let us know you wish to return an item.

We can only accept goods that have been mailed back to us following the procedure outlined below:

  • Goods must be returned to us in a fully 're-saleable' condition. They should be unworn and unaltered, in the original box and packaging

  • If the item is not returned in its original condition, the buyer is responsible for any loss in value. We are permitted by law to reduce the amount refunded to reflect any reduction in the value of the goods

  • When returning items we strongly advise you to obtain proof of posting. We also recommend using Royal Mail Special Delivery for insurance purposes as we cannot be responsible for any returned goods until they reach us

  • We are not responsible for any damage or loss to the goods that occurs before they have reached us, including while the goods are in transit. In such situations proof of postage will be required by you, the customer, to make a claim with Royal Mail or any other courier you have used. Please be aware that not every shipping option is insured for posting jewellery.

As soon as the returned goods are received and have been inspected a refund will be issued via the original method of payment.

We endeavour to reply to any emails or messages through the within 24 hours. This may be extended during weekends or holiday periods.

LIMITATION OF LIABILITY

On our site we publish information pertaining to the stones and crystals used in our jewellery. This information is provided to be reference only. We do not endorse the use of healing crystals. By using this site you are adhering to these terms and therefore Elaine Gemmell will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fess from your use of our site.

UPDATES TO TERMS AND CONDITIONS

The Terms and Conditions on this page will be the most current version. It is your responsibility to check our site periodically for any changes. Your continued use of our site following the changes to the Terms and Conditions/Terms of Sale denotes acceptance of those changes.

Any changes to Terms and Conditions/Terms of Sale will be announced on the home page banner.

The terms that apply to you are the Terms and Conditions/Terms of Sale that appear on the site on the day of purchase.
